Important notes for your orders or bookings

Conditions of participation:

The adult courses are 4 hours a day with a minimum of 3 people in a group. If there are less than 3 people, the course will be changed into a half-day course of 2.5 hours. If a group is reduced to less than 4 participants, we reserve the right to combine the groups or to reduce the number of course hours.

Multiple changes of instructor are possible due to our flexible organisation.

We disclaim any liability for accidents that occur during or before the ski course. Accident and liability insurance is the responsibility of the course participants.

Refunds due to injury or illness are only possible with a medical confirmation or a sick note. Only unused days (difference) will be refunded. 8% cancellation costs, discount costs and rebooking fees will be deducted from the refund!

Course cancellations due to weather related conditions (force majeure) will not be compensated. Private courses take place in all weather conditions. The course ticket is not transferable! Unused course days expire!

Payment:

You can pay with a credit card (Mastercard and Visa) or an EC Maestro card, instant transfer, Paypal or per invoice. The entry is made in the online shop via the Wirecard payment system through which you can pay safe and securely!

All deliveries and services of the ski school based on online orders via the internet or other online services are based on these terms & conditions.

Payments via invoice should be paid into our account within the 2 week period. If the deadline is not met, the booking is cancelled automatically!

Important information:

  • Ski equipment includes skis, boots and poles! (helmets are only included in the all all-inclusive packages!)
  • The lift pass is NOT included in the price of the course!
  • Lunchtime supervision is NOT included in the price of the course!
  • When both parents rent skis, the equipment for children up to the age of 10 is free!
  • Course extension for children’s courses: difference plus €10.00
  • Course extension for adults (from 3 days): €30.00 per day including equipment €35.00
  • Lunchtime supervision including food and drink


Early bird discount:
The early bird discount of 5% is deducted on all ski courses and private lessons or alternative sports such as Segway or snowbikes. 10% combination discount will further be discounted on all rented items! For additional products, all-inclusive packages or other special offers and packages there is no additional discount as the basic price of these products has already been reduced by 10%! *On all-inclusive offers, lift passes and lunchtime supervision, no online discount is possible, as this is only possible for courses and rental equipment!


Conditions of cancellation:

  • Up to 7 days before 0%
  • Up to 6 - 3 days before 80%
  • Up to 2-0 days before 100%
From 7 days to 24 hours before the start of the course or during the course, due to an accident, illness, COVID, a travel warning, quarantine, etc., cancellation is also possible free of charge upon presentation of a medical certificate / notification.

ATTENTION: If the days are not used, the difference will be refunded! A processing fee of € 20 will be deducted for all cancellations.

Course card which have already been used are only taken back in case of an accident or illness upon production of a doctor's note and only the Difference is being refunded!

The ski school/the ski rental (hereafter referred to as ‘author’) assumes no responsibility for the validity, correctness, completeness or quality of the information provided. Liability claims against the author which refer to material or non-material damages, which have been caused by the use or non-use of the information provided or by the use of incorrect and incomplete information, are excluded in principle, provided that there is no proof of intentional or grossly negligent fault on the part of the author.

Bookings and reservations of ski and snowboard courses: 
The ski course fee does not include the use of the ski lifts. The ski school will not provide any compensation for lost instructing time due to cable car and lift failures.

Rental and reservation of ski and snowboard equipment:

Each lessee is liable for the proper return of the equipment up to the sales value of the rented products.

The renter is entitled to demand assurance in the form of a document (passport, identity card, driving licence) or a deposit. The deposit of an assurance shall not be considered as a possible purchase price for the equipment.

Court of jurisdiction, place of fulfilment and choice of law:
Place of fulfilment is the central place of establishment of the ski school/ski rental. The competent court at the headquarters of the central branch of the ski school/ski rental is responsible for solving disputes. Austrian law applies. The contract language is German.


Regulations and safety rules for mountain carts:

1. Safety instruction

  • The participation in the mountain cart tour could be risky. Before participating in the mountain cart tour, each participant must attend the safety briefing.
  • The safety instructions must be followed at all times. A participant who does not follow the safety instructions can be excluded from the event.
  • The use of a mountain cart is at your own risk.

2. Equipment
  • When required, appropriate protective clothing can be worn (bicycle gloves, sunglasses against the dust, rainwear, bike protectors!).
  • Wearing a helmet is mandatory.
  • You must wear sturdy shoes.

3. Speed, driving and braking behaviour

  • The speed, driving and braking behaviour must be adapted to one's own ability and circumstances.
  • The driving and braking behaviour of the mountain cart should be adjusted to the road surface (gravel, potholes, bumps, ice, snow, asphalt, concrete).
  • The brakes are checked before starting. In addition, after the start, the braking behaviour must be tested, and a brake test should be carried out at a slow pace.
  • The left brake lever brakes the left rear wheel. The right brake lever brakes the right rear wheel.
  • When both brakes are applied at the same time, the greatest braking effect is achieved.
  • While driving, feet should remain on the footrests!
  • A steering test must be carried out at the start of the journey. The handlebars must be held with both hands.
  • A sufficient safety distance must be maintained.
  • A sufficient distance from the edge of the road must be maintained. Leaving the marked route is prohibited.
  • Corners are to be driven at a moderate speed. The mountain cart has a high lateral stability due to the low overall centre of gravity and the wide wheelbase. If the mountain cart turns too fast, it can tip over or leave the track.
  • Driving backwards is prohibited.
  • On the route you can encounter hikers, animals and mountain bikers. These must be considered. Ready to brake, anticipatory and careful driving is required.


4. Age limits and physical condition
  • You can drive a mountain cart by yourself if you are physically fit and from the age of 10 and have a minimum height of 140 cm.
  • Parents are responsible for minors!
  • Children under the age of 10 can ride in a mountain cart with an adult. Children under the age of 4 are not allowed to ride in a mountain cart.
  • A maximum weight of a 100kg per mountain cart is not to be exceeded.
  • The use of a mountain cart under the influence of alcohol or medication that affects your fitness is not allowed.
  • The guide and organiser reserve the right to refuse guests on the trip. In this case, the costs of the tour will be 100% retained by the organiser.

5. Damages

The participant is liable for all damages to the mountain cart or equipment for which he is responsible. He is liable in accordance with the statutory provisions, in particular for:

  • The necessary repair costs, the amount of which is also determined through an expert’s opinion
  • The expert's fees
  • In case of total loss or theft the full purchase price plus VAT is to be reimbursed
  • Salvage and repatriation costs
  • Depreciation
  • The organiser suffers loss of earnings for the duration of the repair or, in the case of total loss, for the replacement period
  • All additional costs of damage repair
  • Downgrading damages in case of insurance by the organiser
  • The organiser must be informed immediately in the event of damage. A protocol must be drawn up with the names and telephone numbers of the parties involved and the circumstances of the damage.
  • The police must be informed in the event of personal injury.

6. Liability of the organiser
  • The organiser disclaims any liability for accidents that occur during or in the immediate temporal or spatial proximity to the mountain cart tour, unless they are caused by gross negligence or intent by an employee attributable to the organiser.

  • There is no liability and/or comprehensive insurance for the rented vehicles.


7. Safety first

Look ahead and anticipate whilst driving. Be considerate of other riders and hikers or people and animals on the track. Only pass people or animals at walking speed. In the event of a technical malfunction with a mountain cart, the ride must be stopped immediately, and the guide must be notified.

Ride according to your own skills and experience. Do not let the driving behaviour of others tempt you to take risks!


Terms of use and safety regulations for Segway rental and guided tours:
Disclaimer and waiver of liability for the operation of a SEGWAY

1. This disclaimer refers to the operation of a SEGWAY-vehicle and it is pointed out by SEGWAY Flachau, that the handling and operation of a SEGWAY-vehicle involves an increased risk, which has to be accepted by practitioners.

2.  The use of SEGWAY-vehicles as well as the participation in all activities & tours are exclusively and unrestrictedly at your own risk and peril. The participation in the Segway tours is connected with risks. Before participating in the Segway tour, each participant must attend a safety briefing. The safety instructions must be followed. A participant who does not follow the safety instructions can be excluded from the event.

3.  When operating the SEGWAY-vehicle you have to remember that it is considered as a bicycle in the sense of the road traffic regulations and accordingly, the prescribed safety regulations have to be observed. In addition, it is mandatory to wear a helmet. If necessary, appropriate protective clothing can be worn (cycling gloves, sunglasses, rainwear, bike protectors). Firm shoes must be worn.

4.  This exclusion of liability includes claims, regardless of the legal basis, in particular claims for damages, whether they are based on fault or endangerment. SEGWAY Flachau is only liable for personal injury due to intent and gross negligence of SEGWAY Flachau or its employees. The same applies to property damage and financial losses.

5.  The borrowed SEGWAY- vehicle may only be driven by the person who borrowed the device and signed and handed back this disclaimer. The transfer of the SEGWAY-vehicle is prohibited. In the event of non-observance of this prohibition, the tenant is liable for all resulting damages. For third parties SEGWAY Flachau does not take any liability.

6.  Each user of the vehicle bears civil and criminal responsibility for personal injury, property damage and financial losses caused by him/her or the vehicles controlled by him/her.

7 . The use of SEGWAY vehicles is not allowed for people suffering from physical handicaps or those under the influence of alcohol, drugs or medication. Pregnant women or people with heart problems and/or high blood pressure are expressly advised not to use SEGWAY vehicles.


8.  When using SEGWAY- vehicles you must follow the instructions of the operator/renter/guide. The operator/renter accepts no liability for damage caused by its own or third-party fault, by accidents or by improper handling, or if instructions are not followed by the operator/renter or its employees. In case the lessee causes any damage to third parties, SEGWAY Flachau is not responsible.


9.  Before using the SEGWAY, I was informed about the functionality and the safety rules. In particular, the following safety rules must be observed:

a. For the use of the SEGWAY- vehicle in Austria, the road traffic regulations apply as they do for bicycles. People under the age of 18 are only allowed to operate SEGWAY- vehicles when accompanied by an adult. The minimum age for the tours is 12 years when accompanied by parents or 10 years with a bicycle test when accompanied by parents. For obstacle courses in cordoned off areas, youth centres or events in parks and gardens, the minimum age is 7.

b. With SEGWAY- vehicles you are allowed to ride on those roads also accessible to bicycles. In particular, using the SEGWAY on pavements and exclusive pedestrian zones is expressly prohibited.

c.  Do not get off from the vehicle during the journey. Both feet must remain on the standing platform, as the pressure sensors on both standing surfaces must bear weight permanently.

d.  When operating the SEGWAY, it is not allowed to take pictures or to film whilst moving. In general, you should always keep both hands on the handlebars when operating the SEGWAY-vehicle. Hands-free or one-handed driving is expressly prohibited. The exception to this is the hand signal when turning.

e.  When riding with the SEGWAY-vehicle always choose a speed that is fitting to the traffic and the environment.

f.  When riding in a group, a minimum distance of 10 metres or 2 seconds to the person in front must be maintained. In addition, a minimum lateral distance of 1 meter must be maintained.

g.  The rider of the vehicle must take into account uneven ground, damaged roads, potholes and puddles and avoid them. Driving over edges of pavements or similar obstacles is prohibited and may lead to an accident. When coming across such obstacles, the SEGWAY vehicle must be pushed.

h.  Only one driver is allowed per vehicle. It is forbidden to take other people with you, especially children.

i.  The instructions of the operator/lessor or his employees must always be followed. Ignoring the instructions may result in the termination of the journey. In this case there will be no refund of participation or rental fees. The same applies in case of suspected alcohol or drug influence.

j.  After completion of the journey, the vehicle must be returned to the operator/lessor. Any damage to the vehicle must be reported immediately.


10. Damage -  The participant is liable for all damage to the Segway or equipment for which he is responsible. He is liable in accordance with the statutory provisions, in particular.

  • The necessary repair costs, the amount of which is also determined through an expert’s opinion
  • The expert's fees
  • In case of total loss or theft the full purchase price plus VAT is to be reimbursed
  • Salvage and repatriation costs
  • Depreciation
  • The organiser suffers loss of earnings for the duration of the repair or, in the case of total loss, for the replacement period

11Organiser's liability  The organiser assumes no liability for accidents that occur during, or in the immediate temporal or spatial proximity of the Segway Tour, unless they are caused by gross negligence or intent by an employee attributable to the organiser.

There is no liability and/or comprehensive insurance for the rented vehicles.

Safety first – look ahead and anticipate whilst riding. Be considerate of other riders and hikers or people and animals on the track. Only drive past people or animals at walking speed. In the event of a technical malfunction on a Segway, the ride must be ended immediately, and the guide must be notified.

Ride according to your own skills and experience. Do not let the driving behaviour of others tempt you to take risks!
